Legal Question in Personal Injury in Georgia

Our daughter was riding a 4 wheel ATV with a friend, who driving. The ATV is her friends family's. Her friend got distracted and they impacted with some and were thrown from ATV and it landed on top of our daughter. The driver had a fracture in her back and was released home the next day. Our daughter was airlifted to a larger hospital and found to have a head injury and a vertebral fracture. She is just now slowly waking up but may be looking at surgery for the break in her neck and possible residual cognitive problems from the head injuries. We have insurance but also have copy's. We are also concerned about possible long term care. Our daughter is 20 yo and she had just finished a certification course for a medical position and was waiting to take her certification test.

Our question is whether or not there is legal course we can take to try to help with copays and any care she needs from those?

You should file claim BUT you need to hire an attorney FIRST so insurance company will pay what she deserves

I am very sorry to hear of this accident. This is a very serious situation, and it is terrible that you are all going through this. It is a case where you will need a lawyer ASAP for a number of reasons. The immediate medical expenses will not be covered except through your insurance, and the copays will be your responsibility until any (if any)medical pay insurance coverage from the responsible parties can be utilized. Kim: I am very sorry to hear of this tragic event. When something like this happens it not only happens to the injured person but to the entire family as well. First, do not have any contact with the liability insurer of the owner/driver of the ATV without having first hired a capable attorney who knows how to handle a case of this type. Absolutely do not let your daughter give any statement either written or oral about the facts of the event to anyone (she may physically not be able to do so).There are many lawyers who claim to know how to handle this type of case. The reality is there are really very few lawyers who know how to handle this kind of case well. If you have health insurance that covers your daughter (that's how I interpreted your message) make sure that health insurer is notified ASAP and is paying the bills. Try to avoid having the hospital provide treatment on a "hospital lien" basis as the hospital will try to take some or all of your daughter's compensation in a greatly exaggerated amount for treatment. They may try to do this EVEN IF YOU HAVE HEALTH INSURANCE. This is something an expert attorney can help with. The issue about co-pays and long-term care for your daughter are things that are dealt with by your attorney as part of the overall claim. Do not try to do it yourself. These things are done by the attorney and should not cost you anything as additional attorney fees. That is all supposed to be covered by the contingent fee representation of your daughter's and family's interests.
