Legal Question in Personal Injury in Georgia

Injury Case

My son was a victim of a shooting at the Lowndes County Civic Center. He was badly injured leaving more than 300 pellets in his body. This happened on the county property no lights were on outside the building when the shooting occurred. Six people were injured my son, being hurt the worse. Do I have a lawsuit case against the county and entertainment company?

Why did the person shoot your son? Did an employee of the county or entertainment company (whoever they are - you didn't say) shoot the gun? How would lights have stopped the shooting? Did the county undertake the responsibility to stop random acts of violence by providing full-time lighting in every area of county property? These are but a few of the many questions a local lawyer needs to address.

There is a possibility of liability, but I would need more facts to properly advise you concerning your son's injuries. There may be liability for inadequate security or other negligence theories, however proving causation, in light of the intervening criminal act, may complicate the matter. I have handled some serious cases involving civil liability of property owners with regard to criminal assaults on the premises. Those are tough cases, and all those who previously responded to your quesetion raise valid points.

First, we would need to know whether the civic center is operated by the county government directly (in which case there would be serious questions of governmental immunity) or by a separate authority which might have liability.

If an authority separate from county government owns the civic center, we would need to know the complete history of violent crime at that location that would put the property on notice of the risk, as well as a complete investigation of the incident.

Then, if there appeared to be a case, I would want to associate a local attorney who has intimate familiarity with the players, bearing in mind that "a good lawyer knows the law but a great lawyer knows the judge."
