I was involved in an auto accident in which I was rear ended. I went to the ER and was told I suffer from a herniated cervical disc. How much compensation can I expect to receive?

There's no way to answer without a great deal more information, including a review of your medical file and prognosis, your lost earnings, which insurer is involved, the accident report, whether you have medpay, the size of the medical bills, your marital status, how soon you went to the ER, whether your disc had been injured before, a percentage of future impairment, and many issues.

The one thing that is predictable is that in general you will receive 50 to 75% less in an accident case without a lawyer than with one, and that a delay in retaining counsel also usually reduces a settlement.

You will also significantly reduce the offer that is made if you give or gave any statement to the insurer, formal or informal, without counsel.

A settlement can include lost wages, medical damages, pain and suffering, property damage, and in some cases punitive damages.

Make no mistake.The amount of your recovery will in large part depend on the skill of the lawyer you get to represent you. A herniated cervical disc is a very serious injury. Get representation from a skilled attorney who is an expert in injury cases. Do not hire a DUI, will, securities or divorce lawyer, etc. for this case.Such an attorney does not have the knowledge to handle it and will mess it up. Even if there is a recovery it will not be for the true value of the case. Do not talk to the insurer of the adverse party. The adjuster will try to trick you into saying something that the insurance company and its lawyers can use to their advantage--not yours. One of the issues is the amount of insurance coverage. Finding all available insurance coverages applicable to the claim is one of the things that separates the expert injury attorney from those that pretend to be. That is harder than you might think in many cases. Hire an expert injury attorney ASAP and do EXACTLY as he says.
