Legal Question in Real Estate Law in Georgia

Can we file civil suit after we signed buying our house? Contract had patio which we paid extra to have covered. What we ended up with is wood porch and the posts are not trimmed. All houses in the subdivision have concrete patio except us. Just want to know if we would have a small claims court case.

It depends on the documents and other details. Although the contract is very important on the patio issue, after the closing and your acceptance of the home it is usually not as simple as suing for the repairs or corrections. The first question that comes up from your post is whether the work does comply with the letter of the contract, whether or not you like it. If so, it does not matter what everyone else has (unless the contract specifically stated exactly what was to be done). First, you should try to work it out with the seller. After that, you can try a small claims suit but whether you have a winning case is a different issue. Too late now, but in the future make sure the contracts are very clear, you agree on what exactly is to be done and insect the work, and you don't close until the work is completed as agreed.
