Does a notary have to witness both parties signatures to establish a legal document making it valid

Not neccessarily. The only time a notary is required is when the statute covering the transaction calls for it. E.g., petitions for divorce must include a notarized verification, deeds require a notary as one of two witnesses, etc. Consult with a local attorney.
