Legal Question in Wills and Trusts in Georgia

debt responsibility if spouse dies

I have recently gotten married, and my husband and I are looking into getting our wills done. My question is: He pays alimony for 5 more years to his first wife. If he dies before the 5 years is up, am I responsible to pay her the alimony until his responsibility is fulfilled?

The estate may or may not owe it. Without reading the divorce papers there is no way to answer you.

Unless the divorce decree terminates the alimony obligation on the death of the husband, his estate (not you) will be liable for the balance of the alimony.

You should have an attorney examine the divorce decree to make this determination, preferably in the context of preparing your wills.
