my friend is in jail right now and his mom past away a week ago. in her will she split everything between him and his sister. but they don't get along. now since he is in jail can his sister take that away from him if it is writen in his mom will to split everytghing thing including a house she left behind

Despite your friend being in jail, he is still able to inherit from his mother's estate. Please contact me (or an attorney) VERY soon so that your friend may be represented in any dealings and also to make sure his mother's estate at the time of her death is preserved.

In the will, the mother should have designated an executor. The executor will have instructions on how to divide her assets. If he is in jail, the executor, should discuss with him safekeeping of the inheritance until he gets released. Also, he can give someone a power of attorney to administer his assets and other business while he is in prison.
