Petition to Probate Will

Hello,

My mother is trying to get the deed to her house. The home has been paid off for some time now and she doesn't think she ever recieved the deed.

I called the county probate office and told them about needing the deed. I also informed them of my step father passing in 2001. The house was paid off around 1996? They asked if he and my mother had a will and I said yes. They said they showed that it hadn't been probated. I was asked if he had any children and I said yes he had one son and that I was his step son. In the will it had everything going to the spouce of whoever died first and after the last spouces death, in this case my mother, everything was to go my step brother and myself 50/50.

We haven't seen or heard from my step brother since my fathers death and he has never been any good to any of us. The probate court told me that she would need my step brother and I to sign some documents etc., my mother doesn't want anything to do with him anymore and doesn't want to contact him. Is there anyway to do this without him being involved?
