Legal Question in Wills and Trusts in Georgia

Transfer of car title of deceased

My father's car is still in his name & both parents are now deceased. They both left wills which have been probated & I am the executor of each. I can't find the original title, can I sell the car without getting my sister to sign as I am the executor?

Re: Transfer of car title of deceased

If you dad's will gives you the authority to sell assets, you may sell the car without your sister's signature. If it does not, you can ask the probate court for authority to sell without her signature.

This authority is routinely granted.

If you are in doubt, consult an attorney.

Since we haven't seen the wills or your probate paperwork, there is no way to possibly answer you, as the answer depends on the paperwork. Make an appointment with a lawyer to review the papers.
