Are my limitations enough for disabilty compensation?

I have been employed by this company for 13 1/2 years.Injury occured on the job in 1997, to my lower back.I have been through 3 spinal blocks and therapy,which seemed to help for about 2 weeks. Now the pain is back as bad as before.

The job that I am trained to do consist of heavy lifting and running a machine for 12 hours a day. My limitations are:no lifting,no bending,no twisting,and no climbing.I don't know how much longer the doctor is going to keep me on these limitations however.And I am afraid if and when he takes me off these limitations I will not be able to work.I already have a bad attendance record because the company doctor refused to limit my duties.And there was days that I could not hardly walk,much less run a machine.I cannot afford to miss any time from work.I am scared for my job.

However the did recently offer a buyout package.Which i signed for,because I can no longer do the job that I was hired to do.At the same time I am afraid that I will not be able to find employment anywhere else because of my back.

I was told by several of my co-workers to check out the posibilty of disability compensation.

The workers compensation law is complicated. It appears that you do have a claim, but the issue of compensability depends on unique factual questions concerning your job which cannot be answered without much factual investigation into your particular impairments and your job. Also, the document you have signed may have had a significant effect on your claim. You have one year to file a claim with the workers comp. board. After that you will lose all rights to file a claim. So first of all, file your claim. You would be well advised to seek legal counsel by an attorney with experience in the workers compensation field.
