Legal Question in Military Law in Hawaii

2nd DUI in the State of Hawaii

I recieved a DUI in April 2008 in the state of Hawaii. I accepted it, had to pay $512 fine for the state, did the Army substance abuse for 3 months, and recieved a local letter of reprimand from my command. Now I have been charged with another DUI in this state on October 2008. I was not in the vehicle and still was charged with DUI. I have been informed that I Chaptering can happen. What options do I have? If I have any for dui and military law.

Re: 2nd DUI in the State of Hawaii

You can be chaptered out for civilian offenses or actions that occur completely outside of military jurisdiction. If your command proceeds with this, demand an administrative discharge board where you can be represented by an attorney and present evidence that you should not be separated.
