Non-custodial visitation of minor child born out of wedlock

My 25 yoa son has a 5 year old son that he has not seen since the night he was born. I was able to visit with my grandson for the first year but the mom moved to Boise area & refuses to let us know where she is. My son pays child support, but since they were not married no custody or visitation orders were obtained. We both want to get to know this sweet boy and he, us. Neither of us can afford an attorney and Idaho Child Support Enforcement cannot help us. They have tried to get the mother to contact my son, but she refuses. Can someone offer a suggestion how we might get visitation privileges? I was told that Idaho has a grandparents visitation law, but don't know anything more.

Your son needs to file an action for Paternity and get an order for paternity which will include orders for child support and visitation including grandparent visitation if you file in the case as grandparents. Idaho's grandparent statute is located at Idaho Code section 32-719 which you can access on the internet at www.state.id.us in the legal and judicial pages.
