Getting The House

I am asking this for my aunt.Her husband and her moved into her house in 1978,10 years after they were married. Her husband left her 3 years ago and she's been paying for everything ever since, she also has a mentally handicapped 32 y/o daughter that lives with her and an in home daycare business. Now her husband wants the house as part of the divorce and even though they were married when they received the house, the deed is only in his name. What are the chances that my aunt will get the house?

Re: Getting The House

In divorce cases, the Judge tries to divide the property not equally, but equitably, which mean fairly. I would think that a Judge would be very sympathetic to your aunt and she would receive a favorable division. The fact that the deed was only in his name should not cause any problems.
