Legal Question in Business Law in Illinois

I am trying to get a towing company to pay for damages to my car caused by their trucks tow system. I have followed all of their instructions including sending them three damage estimates and pictures of the damage. Somehow my claim was denied twice. Which is baffling to me being that my wife signed a document at the impound lot stating the damage did occur from the way my vehicle was towed. My question is should my next step be a lawsuit? If so how would I get the lawsuit started? If not what other options do I have?

Since this involved an impound lot, a municipality of some sort must have hired the towing company. If so, you may be able to obtain licensing information that may contain insurance coverage. You can then send a letter directly to the insurance carrier. You may also consider sneding a letter to the municpality to see if they will honor the claim or put pressure on the company. If this information is not available, depending on the amount of the damage, you may wish to file a small claims suit or hire counsel.
