Legal Question in Constitutional Law in Illinois

A hypothetical broadcasting company let out an expletive on tv during a live broadcast, but were not fined for it. The FCC in this case would normally have fined them for it but did not. What constitutional arguments can the broadcasting company make about the FCC? EX arbitrary and capricious(APA), 1st amendment violation, and lack of standing. This case is based off of FCC v. Fox and I would greatly appreciate a few cases that would support any answer!
