Legal Question in Construction Law in Illinois

9 foot ceilings in basement

We paid to have 9 foot ceilings in the basement of our new home. I measured and the ceilings are actually 8 1/2 feet tall, not 9 feet. Basically, I'm getting cheated out of 6 inches. They are refusing to give me a credit. Is there any precident regarding this? I feel I paid for 9 foot ceilings I should get 9 foot ceilings.

Re: 9 foot ceilings in basement

Without reviewing your contract, it is impossible to know your rights. That said, if you have a contract for 9 foot ceilings and have only 8.5 foot ones, you have a claim for breach of contract -- among other potential claims -- for the difference in value of a house with 9 foot ceilings compared to the value of the same house with 8.5 foot ceilings, which would be determined by experts.
