Legal Question in Consumer Law in Illinois

air conditioner purchase dispute

I had a HVAC repairman sell me a new air conditioner that never worked properly. The repairman refused to remedy the situation and said his work was done. A second repairman was able to fix my original unit. The first repairman would not complete a return and full refund. After a lengthy dispute with the credit card company, they ruled in my favor. However, I have an large air conditioner on my floor that I would like out of my house. Am I responsible for delivering it back to the repairman or is it his responsibility to pick up his property? I'd appreciate any advice offered.

Re: air conditioner purchase dispute

This is more a question of seeking a practical solution than a question of law.

Send him a letter that says you've got his air conditioner and that he's welcome to come get it. Tell him that, if he doesn't pick it up within seven days, you're going to start charging him $10 per day as storage fees. That might inspire him to come and get it.
