Legal Question in Credit and Debt Law in Illinois

I have a car currently on payments from a dealership. My brother wanted to take over the payments on the car. I let him. Flash forward several months, he said he doesn't want to make the payments anymore. That's fine with me. I asked for the car back and now he is saying I have to pay him what he paid the last few months for the car. I told him no because he was the one using it. He's saying now that he's going to sue me for the money if I take the car back. My question is can he? I never verbally agreed to pay him for the car.

Yes he can sue you - but I doubt that he would be successful. Anyone can sue another person at any time. Whether they can win is an entirely different story. I agree with you that he had the use of the car so he should have made the payments during that time. Take the car back - change the locks if he has a set of keys
