Legal Question in Credit and Debt Law in Illinois

Money loaned but never paid back

In 2006 my boyfriends teenage sister wrecked his truck, he didn't have adequate insurance and ended up with a $5000 bill for repairs, I paid for the repairs and no one has ever offered to pay me back for it. Who is legally responsible to pay me back? his sister since it was her fault for the accident or him since it was his truck? or would it be half and half? Idon't know what to do but would really like to have my money back. I live in Illinois and any advice or suggestions for this matter is welcome.

Re: Money loaned but never paid back

You have a complicated issue because you paid for repairs to a truck that you did not own or insure, and did not have a written agreement for repayment.

If the teenage sister does not have insurance, and if she is under 18 year of age and her parents do not have insurance for her acts, and your boyfriend refuses to repay you along with a refusal of his sister, then your $5,000 payment looks more and more like a gift that you could not recoup. What city in Illinois do you live? Do you need any attorney? This answer does not constitute legal advice because you are not as yet my client.
