Legal Question in Credit and Debt Law in Illinois

Spousal Responsibility in Illinois

My husband got a credit card after we were married. He owes on the card and it has been assigned to a collection agency. The agency has told me that IL is a community property estate and that I am also responsible for the debt and they can come after me even tho I did not sign on the card. Is this true? What is spousal responsibility in IL? What recourse do we have?

Re: Spousal Responsibility in Illinois

Since many Collectors work on a 50 % commission, they do not feel obligated to be truthful. Illinois is not a Community Property State, without your signature on a contract they could not hold you liable for his purchases.
