Legal Question in Credit and Debt Law in Illinois

Do I have to appear at the Summons Return Date to fight a wage garnishment or can I wait until I receive a Notice of Garnishment from my employer? Also, can a non-wage garnishment of my bank account be granted at the same hearing?

To be technical, there is no such thing in Illinois as a wage garnishment. If they have a judgment against you, they can file a wage deduction proceeding and a non-wage garnishment proceeding at the same time. You have to clain your appropriate exemptions, if any, that you may have, or they would be waived. So it is in your best interest to appear.
