Legal Question in Criminal Law in Illinois

Can someone be charged with attempted murder when they weren't even in the same state? The suspect has not appeared in any line up or victim identification and is being held on an $800,000 bond. There is a preliminary hearing scheduled in a dew days. What will happen at this court date?

Anyone can be charged with a crime if a witness points him out. Weather he was in a different state is a matter of proof. Of course, the police should have investigated that, but most cops take the easy way and do not corroborate the complaining witness.

You should hire an experienced criminal lawyer for this. You ask what will happen at the preliminary hearing. The answer is, there will most likely be a finding of probable cause to hold your friend for formal charges. No experienced criminal lawyer puts on a defense at a preliminary hearing. Besides, a judge can end the hearing as soon as he determines the state has shown probable cause.
