Legal Question in Criminal Law in Illinois
Dear Sir,
I was charged for retail theft November 2011. I am on Court supervision for a term of 12 months. I do NOT have a probation officer and do not have to call any one and do not have to mail anything to anyone.
Its Misdemeanor probation and I am not supervised.
During this period I should obey all laws.
-- I was given 30 hours of community service
-- I was ordered to pay 300.00 us
-- I should notify the court of any address change within 7 days
-- Refrain from entering into designated geographical area: Target
-- Make a final report to court December 2012 .
I already completed the full hours of community service and paid the 300 us to the court.
As I already said with no special conditions on it, other than "shall obey all laws" There is no other restriction. Generally speaking I do not have any restrictions on travel or residence for informal probation.
My question is:
Can I travel internationally WITHOUT somehow violating my probation? I am planning to visit Mexico for two weeks.
Do I need anyone's permission to do it?
Do I need to ask the Judge?

You change between probation and supervision. Based on your sentence I will answer your questions assuming you are on supervision.
You can travel internationally but you will require the permission of the court to do so. In order to do that you will need to advance your case with a motion with the clerk and go before the judge. The judge may deny your request however so I would always recommend bringing in an experienced attorney with you to improve your chances of success to travel.
