felony expungement

My husband was convicted of felony possesion of illegal substances in may of 2005. Since then he has been a model citizen (not just in my eyes), but with the economy the way it has been he has been unable to find work. In Illinois you can seek to have the felony expunged after four years from conviction. He wants the felony expunged so that he can join the US navy, since having a felony is a disqualifying offense, but we don't know the best way to go about things. Does anyone have any information that would be helpful besides telling me to talk to a lawyer?

If you believe that it is expungable, file a petition to expunge. The forms are available at the clerk's office or on the web. If it is not expungable, you can file a petition for clemency.

Most felonies are not expungable. Some drug felonies are. It depends upon how your husband was sentenced. Even with that, he must wait 5 years after the completion of the sentence to expunge. His best course of action now would be to petition the governor for clemency. It's a long shot. Good luck.
