Legal Question in Criminal Law in Illinois

Almost three years ago, I was arrested and charged with misdemeanor theft at my former employer. I ended up doing 40 hours of community service and paid a fine. The charge was dismissed. Right now I am trying to look for employment and my question is can my arrest come up during a criminal background check? If so, how can I get it off my record?

You may be able to expunge or seal the court records depending on the actual charge and the desposition.

Yes, this arrest can show up on a criminal background check. Depending on whether you have any additional arrests or convictions you may qualify for an expungement or sealing or your record. In order to advise you as to which you avenue you can pursue, I would need additional information.

My office handles expungements, sealings and pardons regularly. Please feel free to call if you'd like to discuss your matter further.

good luck
