I am under conditional discharge for a second DUI. I am under conditional discharge for 24 months and I have 3 months left. I have a baiid machine and permit to drive thirty miles from my home. Today I recieved a speeding ticket about 100 miles from my home. I am curious what is going to happen? Thank you.

If those are the conditions of your discharge, then you could be found in violation of your conditional discharge and re-sentenced on the DUI charge. If the State's Attorney in your county finds out about the speeding ticket, he will file a violation and you will need to have a hearing on the matter. If you lose the hearing, you could be re-sentenced on the DUI. I would recommend speaking with and hiring an attorney to represent you on this matter as this is very serious. Questions the judge will likely want to know are:

1) how close are you to completing your conditional discharge

2) what were you doing 100 miles away from home when you were ticketed

3) how fast were you going when you were ticketed

4) have you completed all other requirements placed on you during your conditional discharge

Feel free to call if you'd like to discuss this matter further and good luck
