Hello. I cannot say that you have a right per se to give your son your last night, but a court can make a determination as to whether it is in your son's best interest to have your last name. If you have not already done so, you should file a Parentage Action and have yourself legally declared the father of your son. This will protect your rights as a father. Will be happy to discuss this further and in more detail.
