Legal Question in Family Law in Illinois

Claiming my Kids..

My ex and I have already settled visitation matter by going to mediation, now we have a court date for child support, we had made a verbal agreement that I would buy my kids everything until they start taking away the 28% well now she said that she wants back child support from the past 3 months that we had agreed on this already. I have documented our conversations and saved all recepits for this very same reason. What can happen there? Also I told her that I wanted to claim the kids alternating years and she refuses, she said that since she has Sole Custody she gets to claim them every year? I heard different.

If you and your wife can not decide then the judge will decide for you. As far as paying 3 months back child support I do not believe the judge will accept that since you were under no legal obligation to pay child support pursuant to a court order. Go to court with your receipts and your documentation and the judge will determine the issue.
