Legal Question in Family Law in Illinois

My husband and i are going thru a divorce. We have been married for three years. When he moved into my house, which i owned 5 years prior to meeting him, he said he wanted to pay the mortgage no strings attached if I could pay the utilities and proprety taxes. It came out to be the same amount. Now he wants me to pay him 40,000 dollars to cover the mortgag payments he made while we were together. My house is under water and has no equity. Do i owe him this money?

No - he paid for use and occupancy. tel him you would be happy to quit claim the house to him, if it is in fact under water.
