my ex husband did not sign the birth certificate but some how he is now on the birth certificate without my knowledge is that legal?

Why do you object to him signing the birth certificate? Were you married to him when the child was born? If so, there is a presumption that he is the father. What about a voluntary acknowledgment of paternity, or 'vap'; did he also sign one of those? If so, the presumption of paternity could be hard to overcome.

If he was your husband at the time of the birth, he does not have to sign a VAP. The hospital will list him as the father.
