Legal Question in Family Law in Illinois

Hyphenate my child's name

My question seems simple enough, I have a 7 yr old that I was awarded full custody of in 2000. Since that time I have remarried and would like to add my husbands name to hers. Is it legally possible to do this without her biological fathers permission?

Re: Hyphenate my child's name

Hello. My answer to your question is, no. Since

your first husband is your daughter's father and

your child carries his last name, not only would

you have to get his permission to add your present husband's name to her's, but technically

you would have to legally change the name of your daughter. Under the circumstances, you would probably be in for quite a battle, assuming your first husband disagrees. If you

added your present husband's name to that of your daughter, without telling dad, or without

his permission, in theory, he could take the

matter to court and you might be held in contempt

for violating implied provisions of the Judgment

for Dissolution of Marriage. I would be happy

to answer any other questions that you might have.
