Legal Question in Family Law in Illinois

My mother recently passed away and made my son a benificiary on her life insurance policy. In order to receive this money I have to obtain letters of guardianship, even though my biological son has been with me since i gave birth. My question and biggest fear... Will seeking letters of guardianship create a risk of me losing my biological son?

I can not see how your mother's poor estate planning would create a risk of losing custody. If you embezzle his money being in by you, maybe, but if you follow the law regarding the use the those funds, it should not have any effect whatsoever.
