Legal Question in Civil Litigation in Illinois

return of intented money after breakup

I broke up with my ex-fiance and I had sent her $3000 to buy furniture for an apartment we were supposed to get while we were together. We never got the apartment though. She bought the furniture, never took delivery and returned it for store credit at my request. I now want the money back and she says she is entitled to half of it because we both lost money because of the break-up. Does she have any legal claim to half of anything from the relationship? Also the location of the store is in Illinois and I was in New York at the time this took place.

Re: return of intented money after breakup

Yes and No.

Yes if you gave her the money to buy the furniture for the both of you--in essence making a gift of $1500 to her since the furniture was going to be for both of you. That is if that was the understanding.

No, if you gave her the money to buy furniture for you and you alone and that was the exact understanding of both of you. I this instance, it is likely that she would owe you the entire amount.

I hope this helps,
