Legal Question in Civil Litigation in Illinois

shoplifting

I got caught shoplifting a $3 item. i was taken in back they wrote down my info, took my pic and pic of item, I wasnt banned from the store, and no police were called, and I didn't have to sign anything they said I may or may not have to pay a fine. Does that mean I'm in the legal system? And if I am how long until it can come off?

Re: shoplifting

It probably means that they have not decided whether to prosecute.

I believe the answer to your question as to whether you are "in the legal system" is no, not until the store either files a report with the police or files an action against you in court. The store might just put your photograph and info in their internal files, so if they catch you stealing again they will be much more likely to prosecute. Or, they might still use your photo and info to file a police report.

I'm not sure what you mean by your question about "how long until it can come off?" A police report or court judgment can be part of your record for your entire life. There is no legal limit as to how long this store can keep your photograph and info in its internal files.
