Legal Question in Civil Litigation in Illinois

Statute of limitations - cook co.

what is the statute of limitations for small claims court in cook co. il?

I leant a friend $ for a deposit on an office space and he never paid back- even after multiple attempts to collect. This happened 2 years and 2 months ago. Is it too late to pursue this in small claims court? This is for less than $5,000.

Thank you!

Re: Statute of limitations - cook co.

Your claims sounds in "breach of contract." If written, the statute of limitation in Illinois for breaches of written contracts is 10 years from the date of the breach. If oral, the statute of limitation is five years from the date of the breach.
