Statute of Limitation on an auto claim

What is the statute of limitation on an auto claim. I was rear ended in Feb 2005 and the claim has not settled yet.

QUESTION:

What is the statute of limitation on an auto claim. I was rear ended in Feb 2005 and the claim has not settled yet.

ANSWER:

The short answer is:

For the bodily injury claim - 2 years.

For the property damage - 5 years.

However, and this is a big however, if the accident involves a governmental/ municipal body, the CTA, an injured minor or an incapacitated claimant - the time could be longer, or, as short as 1 year.
