Legal Question in Employment Law in Illinois

Collection of Pay and Serverance Pay

What options do I have to sue a former employer who has not paid me for time worked, bonus owed and a agreed upon severance package (which was signed 8/28/2003)? I would like to sue them for all money owed. Other employees have also not been paid.

Re: Collection of Pay and Serverance Pay

If your employer has violated a settlement agreement, your claim is one for breach of contract. Which court would hear the case -- i.e., whether small claims or Law Division, for example -- depends upon the amount in controversy.

If your employer has breached this agreement with you as well as others, it may be having significant financial problems. Thus, even if successful in a lawsuit, you might not be able to collect.
