Legal Question in Employment Law in Illinois

One Day in Seven Law, Illinois,

Can we sue a corporation if I am a commissioned employee?

Example: in a two month period, I worked roughly 43 consecutive, 10-12 hour days, while my manager took a week long vacation in the middle of said consecutive days.

Can we sue the company siting the One day of Rest in Seven law? If so what kind of costs will be involved, what do you think we could get, and can this be settled out of court?

What do you do? Some employees are not guaranteed one day of rest in seven, such as employees who are employed in a bonafide executive, administrative, or professional capacity or in the capacity of an outside salesman, as defined in Section 12(a)(1) of the Fair Labor Standards Act.
