is it legal for United Mine Workers of America (union) to deny pension benefits that were earned and qualified for to receive during employment in a union mine if the recipient returns to work in the coal industry in a non-union capacity???

I am not a labor attorney, but this sounds absolutely wrong. In fact, the law recognizes a great deal of union rights applicable to non-union members.
