Legal Question in Employment Law in Illinois

In their response to the legal complaint, the defendant has lied, via their attorney, in their answers submitted to the court (they have denied certain facts which they have previously admitted in correspondence to be true).

Has the defendant commited perjury ?

What's your goal? Win the lawsuit, I hope. Perjury doesn't win the case. Their attorney should be simply preparing pleadings based on what the client tells the attorney and as long as that's the case, all you have right now is a disparity of factual allegations. While rarely granted because a disparity in facts is usually a killer, if you have firm admissions from the other side and that's their sole defense, you may be able to move for summary judgment supported with the admissions showing there is no real issue of material fact and that you are entitled to judgment as a matter of law, or you may be able to move to strike their pleadings. But this is why attorneys are helpful; they know the procedures needed in situations like these.
