Legal Question in Landlord & Tenant Law in Illinois

I had leased an apartment in chicago last year and the lease is until august end (2009). In june i had moved to california for an internship. Around july 5 a guy had come in as a replacement for me and he agreed to pay me 320$ for one month. It was just a verbal agreement. He has not payed me the rent and he is not leaving the apartment. When we called the police they said that we would have to send him a legal notice as there was a verbal agreement. The agreement was for one month and he has not paid me either. Can i throw his luggage out and lock the door as he does not have the keys. Would the police make me let him in if he calls them.

DO NOT ENTER THE APARTMENT WITHOUT PERMISSION!!!

It sounds as if you "sublet" your apartment. If this is the case, most likely your tenant has to be evicted like any other tenant would be.
