Legal Question in Landlord & Tenant Law in Illinois

i live in cook county illinois and iv'e just been given a 5 day notice by the landlord im in arrears for mays rent $885.00. Iv'e been off work for 10 weeks due to surgery with nothing coming in. How long do i have to vacate? Iv'e tried to work it out with the landlord and he doesn't care he just wants the full amount due.

Technically you might be obligated to vacate 5 days after service, depending on whether you have a written lease or not. Once that time is up the landlord can file a forcible entry (eviction) lawsuit. He will then have to serve you. Then there will be a court date. Then the judge may give you 30 days. The if you don't move the landlord will call in the Sheriff, and nobody knows how long a wait that is now with all of the foreclosures going on; let's say minimally another month. So already we're talking about 90 days, maybe 120. If your landlord is not familiar with what is going on today, it may be worth while approaching him again, depending on how "hot" his building is to lease in. You could be liable for the remaining term, if any, too.
