Legal Question in Medical Malpractice in Illinois

Taking depositions

I worked with a surgeon who is now being sued for a spine procedure. I have been asked to be a witness for the plaintiff. I live over 60 miles from the city where they are requesting the depositon. Do I have to drive there or are they required to come to me since it's such a long distance? I was only there for the beginning of the procedure as a scrub so never even met the patient. I don't remember anything about this procedure. It just seems like a big waste of my time, gas, money for tolls and parking.

As a witness you are entitled not to be incovenienced. You may ask the deposition to be taken at your home or office--whichever is more convenient.

If you do decide to treck 60 miles, remember that you are entitled to your milage and all tolls or any cost of transporation to and from the site of the deposition.
