Legal Question in Personal Injury in Illinois

Defamation of Character

My sister in law uses her office e-mail to send brutal lies about me to mutual family and friends. She has been doing this for years and it stems from the fact I am disabled, but my family refuses to believe it. She sends out emails saying I am defrauding social security because I am not disabled, I am lazy and many other things. I have asked her to stop but she won't, but it has been going on for so long and has been so nasty that I am battling severe depression now. Since she is sending these from her work computer can I sue her employer for Defamation of Character? She happens to work for a major insurance carrier as a life insurance underwriter.

Re: Defamation of Character

Good question. I doubt if you can sue them for defamation as it is unlikely that she was acting as an agent and the insurance company is not in the publishing industry. If she used their stamps and sent out defamatory letters you would not be able to sue them. I see little difference based on the information provided.
