Legal Question in Real Estate Law in Illinois

My 25 year old daughter is living with me. The time has come for her to go on her own and when I told her she needs to move she says she won't. She gives me 300.00 a month rent. Do I have to give her a 30 day notice to move before I change the locks on my apartment?

Not only will you need to serve her with proper written thirty day notice, but if she does not leave by the end of the next lease term, you will need to file a lawsuit to evict her. You cannot simply change the locks after thirty days. A judge needs to order her out of the house. I would suggest that you hire a landlord-tenant law attorney to assist you with this. Any errors on your part will cost you in terms of time and money.

I absolutely agree with Attorney Moens. Particularly in Chicago, you need to be very cautious to keep yourself out of trouble.
