Legal Question in Real Estate Law in Illinois

if an abstract states in it that the property you own (or purchasing) gets its water from a well that is at another house and was installed by that other homeowner does that abstract give you eternal access to that well? The only oral agreement ever made was that if you were hooked into that well you had to pay a certain amount yearly to the owner of that well. Lets say some paid, and some did not, could the owner of the well unhook the unpaid people even if it says in the abstract that they get their water from the well.

It depends on what the document actually says. It could be license, which means it could be terminated. Since you suggest you are looking at an abstract, that would indicate to me that you do not have the most recent information, since abstracts are rarely updated in Illinois. It could be that the agreement has been modified. In short, to get a definitive answer to your questions, you will need to speak with a real estate attorney in your area.
