Legal Question in Real Estate Law in Illinois

I am coexecutor on a will for my sister. The only asset is the house. I will own half of the house along with my sister's boyfriend once she passes. Can he hold up the sale of the house? They own it as tenants in common. Thanks

It sounds like you are facing the impending loss of a loved one. I am sorry to hear that. It would serve you (or your sister) well to have an attorney consider the will and the current title status to better advise you. While you sound fairly certain about the status of things, the legal repercussions could be significant if you are incorrect. The short answer, however, is that there can always be difficulties in co-ownership situations. If you inherit your sister's one-half interest under the will, then short of an agreement to any transaction, a court partition action may become necessary.
