Legal Question in Real Estate Law in Illinois

Roomate

I have lived in a condo for almost 2 years in which my sister and I bought together. She agreed to make the 20% down payment and I agreed to live in the condo and pay all of the mortgage, taxes and assessment fees. My sister has never and will never live in the condo. She has her own home. I want my girlfriend to move in with me and my sister says no. Does she have the right to control who lives with me when both my name and sisters name is on the deed and mortgage? She told me that if my girlfriend moves in with me, she will call the police and take me to court. My girlfriend is a successful intelligent women, but my sister does not like it that I am not available as much as I was as a single man. This is my home, does my sister have a say in who lives with me?

Re: Roomate

No. Your are a co-owner, not a tenant. Maybe not even if you were a tenant.

Re: Roomate

Absent an agreement to the contrary, your sister has no say. However, she could sue to partition the condo, and force you to buy her out, or she could allow anyone she wants to also stay there. So try to work it out.
