Can I appeal an EEOC decision

Hello,

If the EEOC found cause in my complaint, investigated for 5 months, and found that sexual harassment did exist in the company I used to work for, but didn't side with me on my retaliatory discharge claim (I know the company fired me for threatening to file with the EEOC), can I appeal the EEOC's decision?

Assuming you are not a federal employee, you do not need to appeal the decision. You will receive a right to sue letter concerning your right to file a lawsuit in federal district court on your retaliation claim; it will apply to your race claim as well if it is not settled through the EEOC's conciliation process. Remember that you only have 90 calendar days from the day you receive your right to sue letter to file your lawsuit. Good luck.

And be careful - you may want to get an attorney because although you can file pro se in federal court, there are specific elements that are needed to prove your case and this may bog you down if you are not aware and end in a judgment against you - especially if you are so sure you can prove it. Research your law if you plan on going it alone.
