Legal Question in Wills and Trusts in Illinois

Certify a Will

My mother's will was not probated since the estate was small. I am trying to claim unclaimed property from the State Of Illinois. I have already submitted a small estate affidavit and sent them a copy of the will. Now they say they need a court certified copy of the will. Is this something I can do myself or do I need an attorney?

Re: Certify a Will

If the will has already been filed with the court clerk, they will certify a copy for you for a fee. They should be able to do this even without opening a probate estate.

If you have not filed the will with the county, according to Illinois law, it must be filed with the probate clerk in the county where your mother died.

Good luck to you.
